Spain's CNMC fines Endesa's Energía XXI €320,000 for brand confusion
The Spanish Competition and Markets Authority (CNMC) imposed a fine of €320,000 on Energía XXI, the regulated electricity retailer of the Endesa group. The penalty, reduced from an initial €400,000 after the company applied a voluntary‑payment discount, addresses violations of the law that requires clear separation between the branding of regulated and free‑market electricity providers.
CNMC said Energía XXI used the Endesa name and visual elements in phone contacts and contract documents, making it difficult for customers to distinguish the regulated retailer from the group’s free‑market brand. No actual damages, economic benefits or intent were proven, and the fine has already been paid.
