CNseg challenges Mato Grosso do Sul insurance law in Supreme Court
The National Confederation of General Insurance, Private Pension, Life, Supplementary Health, and Capitalization Companies (CNseg) has filed a lawsuit with the Brazilian Supreme Federal Court (STF) against Law 6.520/2025 of the state of Mato Grosso do Sul.
The state law requires insurance companies to formally communicate the refusal of an insurance proposal to the consumer, their legal representative, or the broker within 25 days. Failure to comply can result in fines and sanctions under the Consumer Defense Code.
CNseg argues that the state law is unconstitutional, claiming it usurps the federal government's exclusive authority to legislate on civil law and insurance matters. The entity maintains that the insurance market is governed by national standards, specifically citing the Federal Law 15.040/2024, known as the Legal Framework for Insurance Contracts. The case has been distributed to Minister Flávio Dino.
