College football navigates NIL compensation and antitrust legislation

The landscape of college athletics continues to evolve through new Name, Image, and Likeness (NIL) compensation models and legislative efforts. David Epps, CEO of Peach Bowl, Inc., highlighted a recent shift where Auburn University players received approximately $6 million in compensation related to the Aflac Kickoff game against Baylor. This arrangement was facilitated by moving the game from Auburn to Atlanta to increase market exposure and authenticity through student-athlete involvement in marketing.

Simultaneously, the U.S. Senate is considering the Protect College Sports Act (PCSA). Critics of the bill argue that it seeks to grant unprecedented antitrust immunity to the NCAA and its member institutions while failing to recognize college athletes as employees. Opponents suggest that true reform would require the NCAA to engage in collective bargaining with an independent players association, similar to professional sports leagues, rather than seeking federal exemptions to avoid antitrust litigation.
