Peru's JNE maintains 50% electoral threshold for 2026 elections

The Jurado Nacional de Elecciones (JNE) in Peru has issued several rulings impacting the 2026 regional and municipal elections. The tribunal decided to invalidate Law 32657, which sought to reduce the minimum regional participation requirement for political parties from 50% to 30%. By applying the principle of legal security and prohibiting retroactivity, the JNE maintained the 50% threshold, placing parties such as Fuerza Popular, Juntos por el Perú, and Ahora Nación at risk of losing their legal status and public funding.

Additionally, JNE President Roberto Burneo addressed concerns regarding ‘disguised re-election.’ While the Pleno confirmed there is no express constitutional prohibition for sitting mayors to run as first councilors, the body has yet to define the legal implications if a winning list allows a councilor to assume the mayoralty.

In separate regulatory matters, the JNE established new rules for territorial demarcation consultations scheduled for 2027. To participate in the electoral roll, citizens must prove at least two years of residence in the area under consultation as of April 30, 2026. This measure aims to provide demographic accuracy and legal predictability for processes in departments like Huánuco.
