Colombia Council of State rules on limits of protest rights

The Colombian Council of State has issued a ruling regarding the legal limits of the right to protest. The decision follows demonstrations held between July 31 and August 15, 2017, near the Ecopetrol Chichimene station in Acacías, Meta.

During these protests, access to the station was blocked, worker entry was restricted, and the movement of machinery and supplies was hindered. Consequently, the court held a community organization and its then-president patrimonially responsible, ordering them to provide joint reparation for the damages caused.

The ruling emphasizes that while Article 37 of the Colombian Constitution guarantees the right to peaceful assembly and manifestation, this right does not authorize indefinite blockades, destruction of property, or the deliberate disruption of essential economic activities. The decision clarifies that individuals and organizations can be held liable when protest actions cross into illegal conduct that causes demonstrable harm to third parties or public assets.
