Colombia: Decree redefining ‘Línea Negra’ sparks legal debate

President Gustavo Petro issued Decree 0514 on May 19, 2026, to redefine the ‘Línea Negra’ (Black Line) in the Sierra Nevada de Santa Marta. This move has reignited intense debate regarding indigenous autonomy, territorial planning, and the legal scope of executive powers.

The controversy follows the Council of State's annulment of a previous 2018 decree issued by former President Juan Manuel Santos. That decree was invalidated due to legal flaws, primarily the lack of comprehensive prior consultation and issues with official cartography.

Legal experts have raised several concerns regarding the new decree. First, there are doubts about whether effective prior consultation will be conducted with all affected groups, including Afro-descendant communities. Second, there is a risk of infringing upon territorial competencies, as the redefinition impacts land use, infrastructure, mining, energy, and tourism within the departments of Magdalena, Cesar, and La Guajira. Finally, jurists warn of potential threats to legal certainty and investment stability in these strategic economic areas.
