Colombian courts rule on President De la Espriella and religious neutrality
A Colombian court has issued rulings regarding the religious neutrality of the state in relation to President Abelardo de la Espriella. The 804th Transitory Family Court of Bogotá ruled in a tutela action that the President must refrain from official acts that identify the State with a specific religion while performing his duties as Head of State.
This decision follows a legal challenge regarding the President’s participation in a religious event, the ‘Gran velatón por las víctimas del terremoto’, held in Bogotá’s Plaza de Bolívar. The court emphasized the need to distinguish between a leader’s personal beliefs and their official public functions, prohibiting the use of official channels to promote a specific faith.
In a related development, the Superior Court of Bogotá revoked a previous order that had required the President to apologize for religious references made during his inauguration. Legal analysis suggests that while the Colombian State is secular and prohibits the adoption of an official religion, it is not an atheist state. The rulings clarify that public officials retain their personal religious freedoms, provided they do not govern in the name of a specific creed or coerce citizens into religious participation.
