Colombian Supreme Court issues rulings on child rights and identity
The Civil, Agrarian and Rural Cassation Chamber of the Colombian Supreme Court of Justice has issued rulings protecting the fundamental rights of minors regarding family identity and parental bonds.
In one ruling, the Court determined that the sustained obstruction of contact between children and a parent following a divorce constitutes a form of domestic violence. The Court noted that such behavior can harm the mental health and emotional integrity of children. Judges were instructed to identify obstructive conduct through objective indicators, such as prolonged unjustified absence of contact or the use of legal processes to maintain separation, rather than relying solely on clinical diagnoses or subjective intent.
In a separate decision, the Court blocked an automatic change to a minor's surname following a paternity recognition process. The Chamber ruled that altering a child's name is not a mechanical procedure and must prioritize the child's well-being and social stability. The Court emphasized that a child's name is a fundamental part of their identity in family, school, and society, and noted that current law does not mandate the father's surname be placed first.
