Colombia's Constitutional Court mandates new mental health protocols

The Constitutional Court of Colombia has issued a ruling to strengthen the rights of individuals subjected to involuntary hospitalization for mental health reasons. The Court has ordered the Ministry of Health to establish a clear, binding national protocol to regulate the admission, stay, and discharge of patients in mental health services.

The ruling emphasizes that involuntary hospitalization must be exceptional, necessary, proportional, and limited strictly to the time required to overcome an acute episode. A psychiatric diagnosis alone is insufficient to justify such measures. Key mandates include evaluating the patient's will through reasonable adjustments, considering less restrictive alternatives, and ensuring that hospitalization serves a strictly therapeutic purpose.

Furthermore, the Court requires continuous re-evaluation of the necessity of hospitalization and demands that patients receive clear, understandable information. Any restrictions on communication with family or the outside world must be individually documented and justified. The Bogotá District Health Secretariat has also been tasked with completing investigations into related cases to ensure healthcare providers adjust their practices to these new standards.
