Colorado AG challenges Trump mail-in voting order after Supreme Court ruling

Colorado Attorney General Phil Weiser has pledged to continue legal challenges against mail-in voting restrictions following a U.S. Supreme Court ruling. The court’s conservative majority lifted a lower court’s block on an executive order signed by President Donald Trump, which seeks to modify how mail ballots are distributed for the November midterm elections.

The executive order directs the U.S. Department of Homeland Security to compile a list of citizens using federal databases, requiring the Postal Service to send mail ballots only to individuals on that list. While a federal judge previously blocked the order on the grounds that it unconstitutionally violated the separation of powers, the Supreme Court reversed that decision, stating that the legal challenge by various states was premature because the changes had not yet been implemented.

Weiser, who joined 22 other states and Washington, D.C. in the initial lawsuit, criticized the decision, suggesting the administration intends to “engage in electoral mischief.” The Supreme Court noted that further legal challenges may be possible once the order is active, stating that “time will tell” if the administration administers the order legally.
