Columbus Energy sues Krakow environmental fund for 3 million PLN

Columbus Energy S.A. has filed a lawsuit against the Provincial Fund for Environmental Protection and Water Management (WFOŚiGW) in Krakow at the District Court in Krakow. The company is seeking over 3 million PLN plus statutory interest.

The claims are divided into three categories:

• Approximately 2.74 million PLN for completed investments involving 64 beneficiaries under the ‘Czyste Powietrze’ (Clean Air) program, where funds were allegedly not paid despite completed formalities.

• 248,400 PLN in operational costs, including mandatory energy audits, related to 207 contracts where the Fund reportedly issued positive financing decisions but subsequently halted processing.

• Approximately 30,500 PLN in underpayments resulting from the Fund’s application of maximum price limits after contracts were finalized.

Columbus Energy alleges that the Fund’s actions constitute systemic obstruction of the ‘Czyste Powietrze’ program and include ignoring national guidelines and pressuring beneficiaries to terminate existing contracts with the company.
