Commerce Commission and Essential Services Commission issue regulatory updates

The New Zealand Commerce Commission has issued a draft determination proposing to decline authorization for the New Zealand Gynaecology Association Inc (NZGA) and its members to collectively negotiate with hospitals and the health insurance company Southern Cross. The Commission’s preliminary view is that the potential detriments of the proposed 10-year arrangement likely outweigh the benefits. Additionally, the Commission declined the NZGA’s application for interim authorization, stating there was no evidence of urgency.

In Australia, the Essential Services Commission is seeking public feedback on proposed changes to its regulatory approach regarding major infrastructure projects at the Port of Melbourne. The new role involves assessing major project proposals involving capital expenditure of at least $500 million, specifically overseeing the Port Capacity Enhancement Program. This program aims to build a fourth international container terminal. If projects are approved, the port may be permitted to increase charges to fund the investments.
