Manaus supermarket condemned for illegal work schedules and poor conditions
The Labor Court in Manaus has condemned the supermarket chain Baratão da Carne (operated by Rufino Comércio e Indústria de Alimentos Ltda.) for severe labor violations. A former cashier and packer was subjected to illegal work schedules, frequently working up to nine consecutive days without a day of rest, despite an initial 6x1 contract.
In addition to the exhaustive work hours, the court addressed poor working conditions, including reports of the employee being served spoiled food and lacking proper facilities to eat, sometimes having to eat on the floor or in hallways.
The ruling by Judge Diego Enrique Linares Troncoso of the 9th Labor Court of Manaus recognized an indirect termination of the employment contract due to the employer's serious breach of duty. The company was ordered to pay 594 overtime hours at a 100% premium, along with severance pay, FGTS fines, and R$ 10,000 in moral damages.
Separately, in Santos, the Labor Court condemned Mundial Marítima Serviços Ltda. and its manager, Charly Gueiros Pereira, to pay R$ 150,000 in collective moral damages for employing unregistered workers to clean ship holds in the Port of Santos.
