Condominium management rules and assembly quorum requirements in Italy

Legal rulings and procedural rules in Italy are clarifying the distribution of power and decision-making processes within condominium management. A ruling from the Court of Alessandria (sentenza 28/2026) emphasizes that a second assembly meeting cannot simply bypass the first session for convenience. If the initial summons contains errors, such as incompatible dates or fictitious first convocations, the meeting may be subject to stricter quorum requirements, specifically requiring the vote of at least 667 millesimal parts to ensure transparency and participation.

Furthermore, the distinction between the powers of the assembly, the administrator, and individual owners remains a central point of legal contention. While the assembly manages common areas, approves budgets, and appoints administrators, it lacks authority over private property. For instance, certain parts of balconies that serve an exclusively individual function belong to the unit owner, meaning the assembly cannot unilaterally decide on works regarding those specific areas.
