Condusef provides legal recourse for unauthorized bank transfers
In the event of unauthorized electronic transfers, consumers should immediately report the operation to their bank and file a claim with the institution's Specialized User Service Unit (UNE), ensuring they retain all transaction vouchers and tracking numbers.
If the bank's investigation does not resolve the issue in the customer's favor, the National Commission for the Protection and Defense of Users of Financial Services (Condusef) can issue a technical and legal opinion known as a 'dictamen'. This document analyzes whether the financial institution breached any contractual obligations. Under certain legal requirements, a Condusef dictamen may serve as a non-negotiable executive title, providing a legal basis to pursue the restitution of funds through judicial action.
