Constitutional councils face scrutiny over impartiality and usage

Debates regarding the impartiality and proper use of constitutional councils are emerging in France and Senegal.

In France, discussions have surfaced concerning the objective impartiality of the Constitutional Council. The debate centers on whether members who previously held visible political positions or supported specific reforms should be recused to maintain public trust in the neutrality of judicial decisions. This is particularly relevant when decisions involve irreversible acts, such as laws regarding assisted dying.

In Senegal, retired magistrate Ousmane Kane has criticized the perceived casual use of the Constitution and the Constitutional Council. He warned against treating these fundamental institutions as a “playground,” calling for greater rigor and clarification of competencies. Kane highlighted the need for judicial control over all constitutional matters to prevent institutional uncertainty during periods of political tension.
