Venice Commission warns Georgia's new laws threaten democratic pluralism
The Venice Commission, the Council of Europe’s advisory body on constitutional law, has issued a sharp critique of legislative amendments adopted in Georgia on March 4. The Commission warned that these changes, which restrict foreign funding and political activities, pose a significant threat to the country’s democratic pluralism, sovereignty, and constitutional system.
The advisory body stated that the legislation imposes “disproportionate and unnecessary restrictions” on the fundamental rights and political freedoms of Georgian citizens. Specifically, the Commission noted that the laws could prevent the formation and survival of a political opposition and might discourage individual participation in civic life.
In its assessment, the Commission recommended that the government reconsider using criminal-law sanctions for breaches of grant laws, suggesting instead that such matters be handled through administrative measures with robust procedural safeguards. The legislative package includes amendments to the Law on Grants, the Law on Political Associations, the Criminal Code, and the Administrative Offenses Code.
