Constitutional Court President Petrov clarifies role in election disputes

Vladan Petrov, President of the Constitutional Court of Serbia, clarified the court's role regarding election disputes. He emphasized that the Constitutional Court is not the first or final instance for all electoral grievances, noting that legal protections must first be sought through the Republic Electoral Commission (RIK) and the Administrative Court within prescribed deadlines.

Petrov addressed concerns from certain political actors who attempt to bring disputes to the Constitutional Court without following established procedures or after receiving negative responses from competent authorities. He noted that the court can only intervene if irregularities arise that are not covered by existing protection systems.

As a specific example, the court is currently reviewing an initiative regarding the constitutionality of the Republic Electoral Commission's decision on the design of new voting booths, a matter challenged by parts of the opposition. Petrov also mentioned a meeting with the head of the OSCE Office for Democratic Institutions and Human Rights (ODIHR) mission, noting that the mission head agreed that the country's election legislation is at a historical peak.
