Venice Commission urges Polish President to swear in Constitutional Tribunal judges
The Venice Commission has issued an opinion regarding the appointment of judges to the Polish Constitutional Tribunal. The advisory body recommended that the President should immediately administer oaths to judges elected by the Sejm and should not attempt to verify the legality of the election process. Crucially, the Commission suggested that if a president refuses or delays the oath, the procedure could be completed without the president's physical presence, provided legal formalities are maintained.
This recommendation has intensified the political conflict between the government and President Karol Nawrocki. Prime Minister Donald Tusk criticized the president for failing to respect the Commission's findings, asserting that the Sejm's role is to elect judges and the president's duty is to accept their oaths. Conversely, the Presidential Office rejected the opinion, stating it holds no legal force in Poland and that the constitution and national statutes remain the sole sources of law.
The dispute stems from a months-long impasse where several judges elected by the Sejm have been unable to take office because President Nawrocki has not invited them to swear in. While some judges attempted to take their oaths in the Sejm, the President of the Constitutional Tribunal, Bogdan Święczkowski, has declared such procedures invalid. Opposition leader Jarosław Kaczyński defended the president, citing historical precedents for refusing oaths to candidates who do not meet all criteria.
