Poland Constitutional Tribunal faces leadership and appointment crisis

Poland is facing a deepening institutional crisis centered on the Constitutional Tribunal. The conflict involves the appointment of new judges and the leadership of the court. As the term of judge Justyn Piskorski ends, the Sejm-selected successor, Maciej Berek, faces delays in being sworn in. The President's office has requested documentation to verify Berek's legal counsel experience, a move the Marshal of the Sejm, Włodzimierz Czarzasty, argues is an unlawful challenge to the Sejm's sovereign decision.

Constitutional Tribunal President Bogdan Święczkowski has rejected suggestions that he could be removed from office due to political pressure. However, government officials have indicated they are considering various scenarios, including potential police intervention if legal norms are breached. The dispute also extends to the Tribunal's 2027 budget, which remains contested between the court and the Ministry of Finance.

Simultaneously, political tensions are manifesting in public protests. PiS members, including Przemysław Czarnek, have demonstrated outside the Tribunal, warning that the current government seeks to dismantle the institution and undermine national sovereignty. In a separate matter, a poll by United Surveys indicates that 46.5 percent of Poles doubt the impartiality of the prosecution, supervised by Waldemar Żurek, regarding the Zondacrypto investigation.
