Consumer advocates warn against streaming subscription withdrawal tricks
The Consumer Advice Center Baden-Württemberg (VZ BW) has issued a warning regarding the right of withdrawal for streaming subscriptions. Consumer advocates clarify that immediate use of a streaming service does not automatically result in the loss of the right to cancel a contract.
This guidance follows a case where a customer mistakenly purchased an annual subscription instead of a monthly one and attempted to withdraw shortly after. The provider rejected the withdrawal, claiming the customer had waived their right to cancel in order to access the service immediately. However, advocates state that such a waiver is only permissible for digital download content, such as video games or e-books, where the service is provided instantly.
Because streaming is considered a digital service that is only fully rendered over the duration of the contract, a total exclusion of the right to withdraw is considered unlawful. In the event of a valid withdrawal, providers may only claim compensation for the value of the services already rendered.
