Consumer rights apply to AI-generated advertising
Legal experts note that artificial intelligence does not exempt companies from liability regarding the advertisements it creates. While AI makes it easier to produce and alter food images—such as increasing portion sizes or adding ingredients—the legal responsibility remains with the supplier.
Under the Brazilian Consumer Defense Code (CDC), specifically Article 30, any sufficiently precise information or advertising regarding products or services becomes part of the consumer contract. If an AI-generated image creates a specific expectation in a consumer that is not met by the actual product delivered, the supplier is legally obligated to fulfill that expectation.
