Brazil’s National Traffic Council (Contran) has approved new regulations for the enforcement of the 'Lei Seca' (Drunk Driving Law). The new rules, established through Resolution No. 031/2026, replace the previous 2013 framework and introduce standardized procedures for screening drivers and using enforcement equipment.

A major update in these regulations is the explicit authorization and prioritization of devices used to detect psychoactive substances, such as drugs, in addition to traditional breathalyzers for alcohol. Enforcement can now include breathalyzers, clinical examinations, or the use of specialized devices to identify chemical presence, as well as other legal evidence like video recordings.

Separately, legislative efforts are underway in the Senate. Bill 1.229/2024, authored by Senator Fabiano Contarato, seeks to mandate toxicological and alcohol testing following traffic accidents. The bill also proposes stricter criminal penalties, including making involuntary manslaughter committed under the influence of drugs or alcohol a non-bailable offense.
