Corte di Cassazione clarifies jurisdiction for public company mismanagement
The Italian Supreme Court (Corte di Cassazione) has issued a ruling clarifying the legal jurisdiction regarding financial mismanagement within publicly controlled companies. In ordinance n. 23220, dated July 14, 2026, the United Sections established a clear distinction between the assets of a public entity and those of the corporate bodies it partially owns.
The ruling specifies that the diversion of funds within a mixed or ordinary participated company constitutes social damage rather than direct damage to the state treasury (erario). Consequently, jurisdiction over the conduct of company directors falls to ordinary civil judges rather than the Court of Auditors (Corte dei Conti). This decision emphasizes the separate legal personality of these companies and mandates that local administrators must actively seek to recover losses to prevent political inaction from undermining the protection of collective funds.
