Costa Rica investigates potential malpractice following newborn death
An investigation is underway regarding potential medical malpractice at Hospital México following the death of a newborn, Eva Margarita, on December 19, 2023.
The mother, Andrea, reported that despite arriving with a healthy, full-term pregnancy, she did not receive timely medical attention or adequate support after noticing the baby had stopped moving. The case is being scrutinized for alleged omissions in care that may have led to the infant's death ten hours after birth.
For over two years, the family has sought justice, but institutional responses from the Office for Victim Assistance and the Ombudsman's Office (Defensoría de los Habitantes) have remained stagnant, with officials repeatedly stating that the case is still in process.
