Council of State orders Genoa to reopen New Year's Eve concert tender

The Council of State has ruled that the City of Genoa must reopen the tender process for its New Year's Eve concert following the unlawful exclusion of the company Duemilagrandieventi. The company had previously achieved the highest score in the bidding process but was disqualified for failing to present definitive contracts with artists such as Ghali, Thiele, and Subsonica.

The court upheld a previous decision by the Liguria Regional Administrative Court, stating that the availability of such contracts should be verified during the execution phase of the contract rather than required during the initial bid evaluation. While the ruling mandates a re-examination of the offers, it does not automatically award the contract to Duemilagrandieventi, nor does it immediately grant compensation for damages.

The tender, valued at approximately 740,000 euros, was originally awarded to Rst Events, which organized a performance featuring Pinguini Tattici Nucleari. Duemilagrandieventi has expressed satisfaction with the ruling and is calling for a rapid implementation of the decision by the municipality, while also reserving the right to seek damages for financial and reputational harm.
