Council of State upholds Bilecik Municipality's EÜTS tender legality
The Council of State has ruled in favor of Bilecik Municipality regarding the legal procedures for its Electronic Fee Collection System (EÜTS) tender. The high court determined that conducting the tender under State Tender Law No. 2886 was legally sound, as the process involves generating revenue.
The dispute originated from a previous ruling by the Eskişehir 2nd Administrative Court. While that court had deemed the municipal council's decision to establish the EÜTS system lawful, it had argued that a different law should have been applied during the actual tender process. Bilecik Municipality appealed this decision to the Council of State.
In its final assessment, the Council of State noted that the Municipal Executive Committee's decision was based on a valid municipal council resolution from December 7, 2023. Consequently, the court overturned the previous decision to annul the proceedings, officially validating the municipality's tender method.
