Court halts wind turbine construction in Westerwald bird sanctuary
The Higher Administrative Court of Rhineland-Palatinate has ruled that the permits for two wind energy turbines in the “Westerwald” bird sanctuary are unlawful and unenforceable. The court found that the required environmental protection measures failed to meet nature conservation standards, specifically regarding the protection of certain species.
However, the court declined to fully revoke the permits. Instead, it ruled that the deficiencies regarding bird and bat protection could potentially be rectified through a supplementary procedure. The legal challenge was brought by a recognized environmental association which argued that the authorities had not sufficiently assessed the impact on protected species or the potential for significant damage to the bird sanctuary.
