Court of Cassation sets precedent for joint property sales

The 7th Civil Chamber of the Court of Cassation has issued a precedent ruling regarding lawsuits for the dissolution of partnerships in jointly owned real estate. The court ruled that all stakeholders, and in necessary cases, their heirs must be included in such legal proceedings.

The decision follows a case in the Darende Civil Court of Peace where a party sought to dissolve a partnership and requested compensation for a house built on the shared property. The Court of Cassation found the lower court's decision deficient because the heirs of a deceased stakeholder were not included in the lawsuit, and no on-site discovery or new expert reports were conducted.

Furthermore, the ruling specifies that while structures such as houses or trees on a property can be sold alongside the land, their values must be calculated separately. The proceeds from the sale must be distributed accordingly: the portion corresponding to the value of the structure is given to the owner of that structure, while the remaining funds are distributed among the other stakeholders based on their respective shares.
