Courts rule in favor of refugee families seeking reunification in UK and Nepal
In separate legal developments, courts in the United Kingdom and Nepal have ruled in favor of refugee families seeking reunification.
A UK immigration court, the Upper Tribunal, overturned Home Office decisions that prevented two Palestinian families from Gaza from joining their husbands and fathers in Britain. The court ruled that the government acted unlawfully by applying its biometric check policy to families unable to access closed visa centers in Gaza. Judge Fiona Lindsley stated that the best interests of the five children involved should have been the primary consideration, noting their difficult living conditions in Gaza.
In Nepal, the Supreme Court ordered the government to stop restricting the movement of Bhutanese refugee children. The court issued a mandamus order to facilitate their departure, ruling that preventing children from traveling abroad obstructs legal resettlement and family reunification. The court emphasized that Nepal has a duty to facilitate rather than obstruct the resettlement process, citing international refugee protection frameworks.
