Courts rule on verbal disputes and public order violations
Courts in Croatia and the Czech Republic have issued rulings regarding verbal disputes and their classification as offenses against public order.
In Croatia, the Municipal Court in Čakovec found a 53-year-old man guilty of disturbing the peace. Following a dispute over a neighbor mowing a portion of his property, the man shouted insults toward his neighbor from an unenclosed area. The court determined that because the shouting could be heard on the street, the location functioned as a ‘fictitious public place,’ resulting in a 300 euro fine plus legal costs.
In the Czech Republic, the Supreme Administrative Court overturned a fine imposed on a man following a family argument. The man had mouthed a silent vulgarity, which was recorded by another person. The court ruled that the silent articulation of an insult in a private, heated context did not constitute an offense due to a lack of social harm and did not significantly disrupt civil coexistence.
