Crefisa ordered to pay damages for aggressive consumer harassment

The Court of Justice of Acre (TJAC) has ordered Banco Crefisa S/A to pay moral damages to a consumer in Rio Branco following a pattern of aggressive credit offers. The consumer, a person with a disability and a beneficiary of the Continuous Provision Benefit (BPC/LOAS), reported receiving approximately 15 credit offer calls per day.

In addition to the frequent calls, the bank sent an unsolicited, though blocked, credit card to the consumer. The court ruled that such persistent and aggressive credit solicitation toward a hyper-vulnerable individual constitutes consumer harassment under the Consumer Defense Code. The judges also deemed the shipment of an unrequested card abusive. The ruling requires the bank to cease all unsolicited credit offers and unrequested product shipments to the consumer.
