Crnogorski forum challenges legality of agreement with Serbian Orthodox Church

The non-governmental organization Crnogorski forum has challenged the legality of the Fundamental Agreement signed with the Serbian Orthodox Church (SPC). The organization has initiated proceedings before the Constitutional Court to assess the constitutionality of the act, alleging that it contains numerous material and procedural violations of Montenegro's legal order.

Crnogorski forum argues that the agreement's preamble serves as an interpretive framework for the entire document, despite not being a normative part of the text. They specifically contest the claim of SPC continuity in Montenegro dating back to 1219, asserting that this ignores the historical position of the Montenegrin Metropolitanate. The group also contends that the government exceeded its authority during the signing process and argues that the legal nature of the agreement cannot be equated to treaties made with the Holy See.
