Croatian group Franak seeks discipline for five Supreme Court judges over loan ruling
Udruga Franak, a Croatian consumer association, submitted an open letter from the President of the Supreme Court requesting the initiation of disciplinary proceedings against five members of a Supreme Court panel. The judges named – President Ante Perkusić, reporting judge Nera Radas, and members Đuro Sessa, Goranka Barać‑Ručević and Mirjana Magud – issued a decision on variable‑interest‑rate loans that the association says contradicts established case law and procedural rules.
The association argues the panel deviated from prior Supreme Court rulings from 2023 and 2025, which declared unilateral interest‑rate changes in loan contracts invalid, and from Commercial Court judgments against Addiko bank. It claims the decision should have been referred to the extended Supreme Court chamber under the Law on Civil Procedure, and notes the case had been pending for four years. Franak asks for disciplinary action and notification of any measures taken.
