Cuba enacts new Housing Law expanding property rights

Cuba has published Law 187, the new Housing Law, which introduces significant changes to property ownership and real estate management. The legislation, which includes three regulations and two resolutions, is set to take effect on October 21, 2026.

Key provisions include the recognition of the right for individuals to own up to two properties, a right that extends to foreign nationals. The law also eliminates the practice of confiscating homes when residents permanently leave the country and removes the requirement for heirs to report the start of an adjudication process for unoccupied homes within one year.

The new framework introduces real estate activities and housing cooperatives as formal management methods. It also provides protections for vulnerable populations, such as youth between 18 and 30, and families with three or more children, allowing municipal administrations to assist with housing costs. Additionally, the law increases flexibility in property transfers, donations, and sales contracts, and removes certain administrative authorizations previously required for rooftop expansions and the transfer of vacant lots.
