Cuba's Supreme People's Tribunal operates under constitutional mandate

The Constitution of the Republic establishes that justice in Cuba emanates from the people and is exercised in their name. The Supreme People's Tribunal holds the highest judicial authority, with a mandate to administer justice according to the law, equity, and transparency.

To ensure functional independence, the Constitution grants the Tribunal authority over the interpretation of the law, making its decisions definitive and binding for state organs, entities, and citizens. Judges and lay judges are selected by the National Assembly of People's Power or the Council of State, a mechanism intended to link the judiciary to popular representation.

Under the constitutional framework, magistrates are subject only to the law and enjoy tenure to ensure impartiality and stability. The institution is accountable to the National Assembly of People's Power, and the legal system recognizes equal rights and duties between professional and lay judges to promote an inclusive social order.
