Cuiabá mayor's office appeals court suspension of lotting decree

The municipal government of Cuiabá filed an appeal with the Mato Grosso State Court (TJMT) to overturn a preliminary injunction that suspended a city decree temporarily halting the review and approval of subdivision projects on parcels smaller than 200 m². The injunction was issued by Judge Clarice Claudino da Silva, who ruled that the decree created new rules that should have been enacted by law.

Cuiabá’s legal team argues that the decree is a precautionary measure under the city’s general police powers, not a new regulatory norm, and that it merely limits the number of pending cases without imposing new requirements. The appeal seeks to restore the decree while the municipal master plan is being revised, warning that allowing new lotting approvals now could cause irreversible urban‑planning impacts.
