Cuiabá court suspends mayor's decree limiting new lot sizes

Judge Clarice Claudino da Silva of the Mato Grosso State Court's Special Chamber issued a preliminary injunction that suspends Municipal Decree No. 12.169, signed by Mayor Abilio Brunini, which required new urban lots in Cuiabá to be at least 200 m² in area with a 10‑metre frontage. The judge ruled the decree exceeded the mayor’s regulatory authority because the parameters were not established in any existing municipal law, violating the separation of powers and the legal reserve principle. The suspension takes effect retroactively while the Direct Action of Constitutionality (ADI) is examined by the Special Chamber.

The decision also ordered the city hall to provide information, and to notify the municipal council and the State Attorney General’s Office. The merits of the ADI will be decided later.
