Cutro murder: Arrest of Giuseppe Sulla validated without premeditation charge
A judge in Crotone has validated the arrest of 28-year-old Giuseppe Sulla, who is accused of the murder of 21-year-old Sergej Kapterv in Cutro. While Sulla will remain in custody due to the gravity of the crime and flight risk, the judge, Elisa Marchetto, excluded the aggravating factor of premeditation.
The ruling follows arguments from the defense suggesting that the incident arose from a dispute during a birthday celebration. Investigators believe the interval between the initial argument and the fatal attack, which occurred around 5:00 AM in via Spagnolo, was only about an hour. The court determined this timeframe did not meet the legal threshold for “cold planning” required for a premeditation charge.
During the validation hearing, Sulla exercised his right to remain silent.
