Cyprus Court of Appeal overturns acquittal in 2018 assault case

The Cyprus Court of Appeal has unanimously overturned an acquittal issued by the Famagusta District Court regarding a 2018 assault case. The decision, issued on October 29, 2026, follows a criminal appeal filed by the Attorney General.

The case involves an allegation from a woman who claimed that during a dispute at a residence in Liopetri on December 7, 2018, her then-partner pushed her onto a bed and injured her left ankle. The complainant reported seeking medical attention at a General Hospital, where she received an X-ray and a cast.

While the lower court had acquitted the defendant due to perceived inconsistencies in the testimony, the Court of Appeal ruled that the original court erred in its evaluation of the evidence. Specifically, the appellate court found that the lower court failed to properly assess the credibility of the witnesses and did not sufficiently evaluate the doctor's testimony as an expert witness. Despite overturning the acquittal, the Court of Appeal declined to order a retrial, resulting in the defendant remaining acquitted.
