Czech Constitutional Court rules on attorney fees for victim representatives

The Constitutional Court of the Czech Republic has issued a ruling regarding the right of an attorney to receive remuneration and reimbursement of expenses when representing a victim categorized as particularly vulnerable.

In this specific case, an attorney represented a complainant in a fraud investigation. The police eventually dismissed the case, concluding that no crime had been committed and therefore the complainant did not qualify as a victim entitled to free legal representation. Consequently, the police denied the attorney's claim for fees and expenses.

The Court ruled that the actions of the criminal justice authorities violated the right to a fair trial. The judgment emphasizes that the status of a victim cannot be assessed retrospectively based on the final outcome of the investigation.
