Czech consumer rights: Hygiene seals can void return rights

Under Czech law, specifically Section 1837 of the Civil Code, consumers may lose their right to return goods purchased online if the protective hygienic seal has been broken. This exception applies to products that, once unsealed, are unsuitable for resale due to health or hygiene reasons.

The Czech Trade Inspection Authority (ČOI) identifies items such as toothbrushes, contact lenses, and certain packaged foods as typical examples where breaking the seal can terminate the fourteen-day right of withdrawal. For an exception to be valid, the product must be in a sealed protective package, and the breach must directly impact its hygiene or health safety. Simply labeling a product as ‘hygienic’ on a box is insufficient to override consumer rights if the legal criteria are not met.
