Czech court overturns driving ban due to postal error

A driver in the Czech Republic successfully avoided penalties for refusing a breathalyzer test and driving without a license due to a procedural error by Czech Post. The driver had challenged a decision by the Prague Magistrate that imposed a 38,000 CZK fine and a 16-month driving ban.

The Prague Municipal Court overturned the sanctions because the delivery notification (dodejka) lacked essential information, including the mail carrier's signature, name, and the post office stamp. The court ruled that the legal fiction of delivery could not be proven because the document was unsigned and unsealed, and the postal service failed to follow instructions regarding the storage period and delivery to the mailbox.
