Czech courts review hazardous‑waste incinerator and wind‑farm disputes

The Supreme Administrative Court in Brno will consider a cassation appeal filed by AVE CZ seeking to modernise a hazardous‑waste incinerator in Rybitví. The incinerator has been out of operation since 2004 and AVE CZ bought the site in 2006. A regional court in Pardubice rejected a proposal to amend the municipal plan, a decision the company contests. Local authorities worry about environmental impact, while the Ministry of Environment’s EIA assessment gave a favourable result under stipulated conditions.

Separately, the Czech Constitutional Court overturned a long‑standing dispute over compensation for two planned wind farms in the Ústí region. The court ruled that Wind Technology could not reasonably expect project completion because it lacked the required exemption to protect the common kingfisher’s habitat. The company is seeking roughly 265 million CZK plus interest. Judges emphasized that the firm’s property rights were not substantially curtailed, and the case will be returned to the district court for further determination.
