Czech Justice Minister defends rape sentencing and legal reforms

Czech Justice Minister Jeroným Tejc stated that the Czech Republic does not belong to the group of countries that lightly punish rape. Speaking at a parliamentary seminar on sexually motivated crime, Tejc noted that following the legal definition change effective January 2025, rape is defined as non-consensual sexual intercourse rather than intercourse forced by strength. This change is intended to ensure that courts issue fewer suspended sentences for such crimes.

Under the new legal framework, rape specifically covers intercourse and other penetrative acts, while less severe sexual practices are classified as sexual assault. The reform also addresses sexual practices involving children under 12, requiring them to be classified as rape or sexual assault rather than the lesser charge of sexual abuse. Tejc emphasized that rape is the most strictly punished crime in the country after murder.

To address judicial practices that may result in disproportionately lenient sentences, the Minister expressed readiness to file complaints with the Supreme Court. Additionally, the Ministry of Justice is reviewing a new amendment following European directives to combat violence against women and domestic violence, which may criminalize actions that were previously not punishable. Future plans include expanding judicial education to better address victim trauma.
