Czech Republic updates consumer protection and loan dispute risks

New legislative changes and legal risks regarding financial services in the Czech Republic are coming into focus. Starting January 1, 2027, new consumer protection rules for remote financial services will take effect. These regulations aim to prevent manipulative online practices, such as 'dark patterns,' and require providers to offer clear information regarding costs and risks. A key feature will be a prominent, easy-to-use online button for withdrawing from contracts, ensuring consumers can cancel services without navigating complex systems.

Separately, legal experts warn of the risks associated with challenging existing loan agreements. While consumer law protects honest borrowers who have been treated unfairly by creditors, attempting to dispute a contract by providing inaccurate information in the original loan application can lead to criminal charges. An audit of a loan relationship often reveals discrepancies in reported income or expenses. Under Section 211, providing incomplete or inaccurate data can constitute credit fraud, regardless of whether the borrower intended to deceive or has already repaid the loan.
