Czech Senate examines residency law disparities for foreign spouses

The Czech Senate's Committee on Foreign Affairs, Defense, and Security is reviewing a proposed law regarding the entry and residence of foreigners. The discussion focuses on potential legal disparities that may disadvantage Czech citizens and their families.

Specific cases highlighted by non-governmental organizations suggest that the current or proposed regulations could lead to unequal treatment. For instance, a Canadian spouse of an EU citizen (such as a Slovak national) may be permitted to remain in the Czech Republic while awaiting an appeal after a residency denial, whereas a Canadian spouse of a Czech citizen might face different requirements and be forced to leave.

Other examples discussed include a Mongolian national who could lose residency rights following a divorce despite maintaining employment. The committee is evaluating these issues alongside proposals for the digitalization of the residency agenda and increased monitoring of foreign students.
