Czech Supreme Court rules on bailiff's seizure of lost property

The Supreme Court of the Czech Republic has ruled in favor of a man whose personal property was seized by a bailiff during an execution process that did not involve him. The man, who was a third party residing in a property that was cleared due to an execution, proved ownership of several items, including a chainsaw, cameras, a notebook, and a ceramic statue.

Although the bailiff admitted the items were lost or stolen, the Municipal Court in Prague initially refused to remove them from the execution list. The lower court argued that because the items could not be physically returned, the purpose of an exclusion lawsuit could not be met, suggesting the owner seek damages instead. However, the Supreme Court overturned this, ruling that the bailiff was unlawfully maintaining the items in the execution inventory.
