Daimler Truck ordered to pay 210,000 euros in gender pay dispute
The State Labor Court of Baden-Württemberg has ordered Daimler Truck to pay approximately 210,000 euros in back wages to a department manager. The ruling, issued on August 18, 2026, addresses gender-based pay discrimination occurring between 2018 and 2022.
The case centered on the reversal of the burden of proof under Section 22 of the General Act on Equal Treatment (AGG). The court determined that the plaintiff provided sufficient evidence of gender-based disadvantage, shifting the responsibility to the employer to disprove the discrimination. Daimler Truck was unable to refute the presumption of discrimination, leading to the court-ordered compensation.
The calculation of the back pay was based on the salary differences identified over the five-year period, providing a legal precedent for how employers must document pay equity to avoid similar litigation.
