Dalfsen court invalidates motorcross expansion permit
A court has ruled that the municipality of Dalfsen incorrectly issued a permit to the motorcross club De Vechtspeurders, allowing for expanded training sessions and competitions. The ruling invalidates the permit, which had granted extended opening hours and increased activity levels.
The court found that the municipality failed to sufficiently explain why increased noise pollution would be acceptable. Specifically, the municipality's noise calculations assumed a maximum of four racing days per week, but this limit was not formally recorded as a requirement in the permit. Additionally, the municipality erred regarding noise barrier agreements; while previous acoustic research suggested two-meter-high screens, the permit specified different, lower measures.
While the motorclub may continue to use the track in the Dalfsen rural area, the expanded operating hours are temporarily suspended due to the ruling. The municipality has not yet announced its next steps.
